Hit by an Uninsured or Underinsured Driver in Arlington
Short answer: Look to your own policy. Uninsured/underinsured motorist (UM/UIM) coverage pays when the at-fault driver has no insurance or too little, and PIP pays early bills regardless of fault. Both are on Texas policies unless rejected in writing.
"Underinsured" is the more common problem
A driver can be legally insured and still not have enough. The Texas minimum is $30,000 per injured person (§601.072). If your losses are larger, your UIM coverage can cover the gap, up to your own limits. Texas insurers must offer UM/UIM, and you can only decline it in writing (Ins. Code §1952.101).
If the driver took off
- Call 911 and report it to the Arlington Police Department right away.
- Write down anything you saw: plate, color, make, direction of travel.
- Ask nearby businesses about cameras, and get witness numbers.
- Tell your insurer. PIP and UM coverage may apply.
A lawyer can look for every policy that might apply. Read PIP or go back to all insurance guides.
