Should You Hire a Lawyer After an Arlington Crash?
Short answer: Texas doesn't require one. But if you were injured and someone else caused the crash, a personal injury lawyer can take over the insurance fight while you recover, usually for no upfront fee. A free consultation tells you whether your case is worth pursuing.
Signs it's time to talk to one
- You're still hurting a week or more after the crash.
- The other insurer wants a recorded statement or sent you a release.
- Fault is disputed, or the police report has mistakes.
- The other driver had no insurance or only the $30,000 minimum.
- You need care but have no PIP left and can't pay upfront.
What a lawyer actually does
Collects the crash report, photos and records. Talks to the adjusters so you don't have to. Can arrange a letter of protection for treatment. Negotiates medical bills and liens, which rarely get reduced without a lawyer asking. Values the claim and, if the insurer won't pay fairly, files suit.
Cost
Contingency fee: nothing upfront, and the lawyer is paid a percentage only if money is recovered. Ask what the percentage is, and how case costs are handled, during the free consultation.
Deadlines
Texas generally gives you 2 years from the crash to file an injury lawsuit (CPRC §16.003). Partly at fault? You can still recover if you're 50% or less responsible, reduced by your percentage (§33.001). Evidence such as video and witness memories fades much sooner than 2 years.
"People with lawyers get less." A closer look
Short answer: The best-known numbers come from the Insurance Research Council (IRC), an insurance-industry-affiliated group, using insurer claim files. They compare very different cases, and independent research points the other way.
| What you'll hear | What the source shows |
|---|---|
| Represented claimants net less per dollar of loss | The IRC's 2018 study: $1.17 per dollar of economic loss without a lawyer vs. $0.78 net with one (IRC 2018). It's a ratio, not total dollars, and represented cases are more serious. |
| The cases are comparable | The IRC's own 2004 survey found represented claimants had medical expenses almost 400% higher (IRC 2004). |
| Lawyers don't raise settlements | The IRC's 1999 survey found represented claimants' gross settlements were higher (IRC 1999). An academic study linked attorney involvement to a 64% larger average claim (Browne & Puelz, 1996), and another found a very strong link in UM/UIM claims (Browne & Pryor, 2004). |
| The research is neutral | The IRC is affiliated with The Institutes, and its president is also the Insurance Information Institute's chief insurance officer (IRC 2025). Law professor Jay Feinman documents claim systems built so "claimants would be deterred from hiring lawyers" (Delay, Deny, Defend). |
For balance: the IRC's 2026 summary reports $1.40 vs. $1.80 per dollar of medical expense with and without attorneys, with fees "estimated at one-third" (IRC), and regulators who examined Allstate's Colossus software found no "systemic underpayment" while requiring better oversight (summary). None of these studies can predict your case.
